Are LLP's 1099 forms reportable?

LLP is Limited Liability Partnership. Form 1099-MISC is Miscellaneous Income. The Payer of at least $600 to a recipient who isn't an employee is required to file Form 1099-MISC.

Although LLP's are recognized in state statutes, they aren't recognized by the IRS. For federal tax purposes, LLP's choose to file as partnerships. Any 1099-MISC form issued to a Limited Liability Partnership needs to be included in the partnership's income that's reported on Form 1065 (U.S. Return of Partnership Income).

For more information, go to www.irs.gov/formspubs for Publication 541 (Partnerships).

Where is your withholding certificate?

Form W-4 is Employee's Withholding Allowance Certificate. It's an IRS form that you fill out for your employer. It includes three worksheets (Personal Allowances, Deductions/Adjustments, Two-Earners/Multiple Jobs). You keep the Worksheets for your records. The employer keeps your completed W-4 form with employer tax records.

For more information, go to www.irs.gov/taxtopics for Topic 753 (Form W-4 Employee's Withholding Allowance Certificate).

How do you claim exemptions with your withholding certificate on your tax return?

Form W-4 is Employee's Withholding Allowance Certificate. It's an IRS form that you fill out for your employer. Employers keep completed W-4 form with their employment tax records.

Often the number of exemptions that you claim on Form W-4 won't be the same as on your tax return. The exemptions on Form W-4 are designed to help your employer deduct the correct withholding amounts from your earnings.

Also, Form W-4 only offers two filing statuses (Single, Married Filing Jointly). But your federal tax return has five filing statuses: Single, Married Filing Jointly, Married Filing Separately, Head of Household, Qualifying Widow(er) with Dependent Child.

In filling out your return, you choose your exemptions according to specified situations (a choice of five filing statuses, personal/dependent exemptions). So you don't match the number of exemptions on your tax return with the number on Form W-4.

For more information, go to www.irs.gov/formspubs for Publication 501 (Exemptions, Standard Deduction, and Filing Information).

What is the maximum number of allowances allowed on a W-4 without having to notify the IRS?

Form W-4 is Employee's Withholding Allowance Certificate. Employers formerly were required to submit to the IRS as W-4 forms claiming more than 10 allowances or complete exemption from withholding on weekly wages of at least $200. Employers now are required to submit W-4 forms only if the IRS specifically requests them.

For more information, go to www.irs.gov/compliance/index.html for 'Withholding Compliance Questions & Answers'. Also, go to www.irs.gov/taxtopics for Topic 753 (Form W-4 Employee's Withholding Allowance Certificate).

How many years do you have to amend a tax return?

There is no deadline. However after a certain point you won't be eligible for a refund or to make certain elections. And after a certain point, the IRS may not be able to collect on a non-fraudulent error you made, but you are welcome to pay anyway just in case you are being considered for a cabinet position.

If you did something fraudulent and want to come clean, it is best to get the 1040X filed before the IRS starts investigating.

If you forgot to claim a deduction, you have until three years after the original due date of the return (assuming you filed on time and didn't make any payments after the due date). You have seven years to claim a worthless security or a bad debt.

If you want to recharacterize an IRA contribution or take a corrective distribution, you have until the extended due date of your return (assuming you filed on time or filed an extension on time).

If you want to switch from a joint return to a separate return, the deadline is the original due date of your return.

There are a lot of different deadlines for a lot of different problems. You are always free to file, but it may or may not do you any good.

What is Form 944 used for?

Form 944 is Employer's ANNUAL Federal Tax Return. Form 944 reports the amount of taxes (income, Social Security, Medicare) withheld from employees' earnings. It's filled out instead of Form 941 (Employer's QUARTERLY Federal Tax Return) by the smallest employers. Smallest employers have an annual federal income tax/Social Security/Medicare tax liability of $1,000 or less. Generally, an employer who pays no more than $4,000 in wages subject to withholding is likely to pay no more than $1,000 in these employment taxes. Because of their low employment tax liability, the IRS allows them to pay these taxes only once a year, with Form 944, instead of every quarter, with Form 941.

Irs has not received your income tax form sent in 41309 by certified mail?

Relax. They are still going through the huge amount of last minute mail. Wait a few weeks before panicking. And actually, never panic on this..you did exactly the right thing by sending it certified. Legally, the IRS has receved your return...a USPS mailing receipt for certified or registered mail (see IRC Sec 7502(c)) is considered prima facie evidence of receipt by the US Government (IRS), and your certified mailing receipt proves this happened on time. You're completely covered.
