If an individual has a capital loss in 2008 can he carry it back to a 2005 capital gain tax paid?

No. But you can use $3000 of the capital loss to offset current year ordinary income and then carry the rest forward.

Be sure to fill out the capital loss carryover worksheet in the Schedule D instructions before you enter a carryover from the previous year. The carryover rules are some of the most confusing for taxpayers and taxpayers cheat themselves out of a lot of carryover. Don't assume you know the right amount to carry over. Use the worksheet.

How can you get a W-2 form from Target Corporation without paying for it?

Form W-2 is Wage and Tax Statement. The IRS requires employers to provide at least three copies of Form W-2 to each employee by January 31st. If January 31st falls on a weekend, then the deadline is extended to the next business day. Your employer is expected to provide/send your W-2 forms to you at no charge to you.

If you haven't received your W-2 forms, contact your employer. If your employer hasn't provided/sent them to you by mid-February, then you should contact the IRS at 1-800-829-1040. The IRS will send a letter to your employer requesting that the W-2 forms be provided/sent to you. The IRS also will send to you Form 4852 (Substitute for Form W-2 or Form 1099-R).

If you haven't received your W-2 forms from your employer by the time you need to file your tax return, then you should complete Form 4852, attach it to your return, and file your taxes that way. If your employer did send W-2s to you but you've lost them, contact your employer. Your employer is required to provide you with a new copy. Your employer will write 'REISSUED STATEMENT' on the new copy. Employers sometimes charge a fee for issuing a duplicate W-2 form.

If you filed for bankruptcy can your daughter claim you as a dependent on her tax return?

Yes. There are two types of dependents: Qualifying Child and Qualifying Relative. Your parents are eligible to be considered Qualifying Relative dependents. Your parents don't have to live with you for you to claim them as dependents. But you must have provided over half of their support, and they must have had gross income of less than $3,500.00 in 2008 ($3,650.00 in 2009).

When is the latest to file supplemental W-2 forms?

W-2 is Wage and Tax Statement. It's a six-part form that the IRS requires employers to file for their employees. Sometimes it's necessary to issue more than one W-2 form to an employee. For example, there may be more than four coded items to report in Boxes 12a to 12d (the Codes boxes). Sometimes employers issue a separate W-2 form to differentiate Wages/Tips from Other Compensation.

Whether an employer issues one W-2 form or multiple W-2 forms to an employee, the deadline is still the same. W-2 forms must be provided/sent to employees by January 31st, or the next business day if January 31st falls on a weekend. Copy A of Form W-2 is due to the Social Security Administration by March 1st if filing a paper form. It's March 31st if filing electronically.

What if a tax return is mailed to the wrong processing center?

If it is just a routine tax return, don't worry about it. The IRS will figure it out.

There have been some court rulings in some obscure cases involving disputes about the statute of limitations when a return is sent to the wrong center, but unless you are involved in some convoluted technical dispute with the IRS, don't worry about it.

Can you prepay federal income taxes?

Yes, you can prepay federal income taxes through estimated tax payments. Generally, you're required to make estimated tax payments if you expect to owe at least $1,000 in tax for 2009 (after subtracting credits and withholding) and if your withholdings and credits are expected to be less than the smaller of 90 percent of the tax on your 2009 return or 100 percent of the tax on your 2008 tax return.

Estimated tax payments are paid quarterly (every three months). You can make estimated tax payments by check or money order attached to Form 1040-ES (Estimated Tax Payment Voucher). Or you make an electronic payment by enrolling in the Electronic Federal Tax Payment System (EFTPS) at www.eftps.gov or calling 1-800-316-6541 (for individuals) or 1-800-555-4477 (for businesses). Or you can make electronic payment by Electronic Funds Withdrawal (EFW). Or you can make electronic payment by credit card. But a convenience fee is charged for this option.
