Yes. A taxpayer identification number (TIN) must be provided on all returns and other tax-related documents. This number is usually a Social Security number (SSN). ITIN is individual taxpayer identification number.

A person who isn't eligible for an SSN but who's required to file a tax return must apply to the IRS for an ITIN. On a Married Filing Jointly return, both spouses must have a TIN in the form of either an SSN or an ITIN.

How can you get a W-2 form for a company that's out of business?

Form W-2 is Wage and Tax Statement. When a company goes out of business, it's required to provide W-2 forms to their employees by the due date of their final Form 941 (Employer's Quarterly Federal Tax Return). The due dates for Form 941 are April 30, July 31, October 31, and January 31.

Link their closing the business with one of these dates. If that date is now past and you have no way of contacting the business (forwarding address, etc.), then contact the IRS at 1-800-829-1040. It's possible that they're planning to send out W-2 forms by the 2010 deadline of February 1st.

But if that's the case, they're only timely if they're closing is linked to the January 31st quarterly deadline. If their closing coincides with any of the other three quarters, then they're actually late in providing W-2s, and you should contact the IRS at 1-800-829-1040.

Also, if you're completely exempt from federal income tax withholding, you need to fill out Form W-4 for your employer. To have complete exemption, you must meet two conditions. One, the previous year all federal income tax withheld from your earnings was completely refunded to you because you had no tax liability. Two, you're expecting this year to be the same situation: any federal income tax that would be withheld would be completely refunded to you.

In a two member LLC how do you file taxes to be treated as a partnership?

LLC is Limited Liability Company. It's allowed by state statute. But the IRS doesn't recognize LLC as a classification for federal tax purposes.

Under IRS Default Rules, a Limited Liability Company with at least two members is considered as a partnership. Form 8832 is Entity Classification Election. An LLC with two or more members would only have to file Form 8832 if the LLC didn't want to file as a partnership. As a partnership, the LLC would file Form 1065 (U.S. Return of Partnership Income).
