If they think you did something and you just left before they could even get anything out of you, they could probably do that. There is nothing in the action that would violate the civil rights of the employee, nor constitute legal grounds for litigation.

If you were fired, then tell them no. Even if you left on good terms with your past employer, you don't want the human resources department to call and get their side of the story before you get completely through the interview process.

You need to be honest and tell them why you left. But try to word it in a way so that it doesn't sound as if you are trying to throw your former employer under the bus. This way, it will show the prospective employer that you are honest and have high morals, yet you won't come across as one who bad mouths others. Say it more as a matter of what you are not comfortable with as far as doing something dishonest or illegal, not that your former employer was a crook, con, etc.
No they can only tell them if you would be rehired by them. If they have nothing positive to say about your performance they can legally tell them that they would not rehire you. They can not bad mouth or give a performance review to a potential employer even if you left under bad circumstances. They are only aloud to tell someone if they would rehire you.
Not much as the funds will be divided up or what they may have left but big creditors will be paid before small debts.

You should never lie about why you left a former employer, even if you were fired. Leaving for better advancement opportunities or to gain additional experience is always a good answer.
