Yes it is a felony, It is a schedule 2 drug under the U.S. controlled substances act. What that means is that it has approved medical purposes but it has a high abuse liability and as such the DEA closely monitors this drug alongside cocaine which is a similar powerful stimulant. I am a junior at West Chester University majoring in criminal justice, and minoring in psychology with an emphasis on pharmacology (study of drugs' effects on the brain) . Trust me if there is anything I know, its Drugs and the Law.

Drugs you may very well know; however, your understanding of the law is, at best, haphazard and misplaced. The particular schedule of a drug does not determine whether the unlawful possession of that drug is considered a felony offense. No direct nexus.

Depends on if it's your prescription, have you been arrested for it? I think class A may be a felony and Adderall is not class A, (actually, I just googled and it varies) Put in your Google or Yahoo search "what classification drug is aderall in whatever shate your in" Added: Adderal is an Amphetamine-based prescription drug. It can depend on the quantity you were caught with (personal use amount or "distributiion-size' amount) all narcotic perscriptions are labled with a federal law warning that it is illegal to transfer any medication to anyone not prescribed it so you could be also looking at felony and federal charges

While he is correct that Adderall is classified as a Schedule II controlled substance, this classification, in and of itself, does not automatically make it a felony.offehse to possess the drug without a valid prescription. There is no definitive YES or NO answer to your question. Rather, the answer is based solely upon the jurisdiction of the offense. What constitutes a felony in one US state may be only a misdemeanor in another state. Each of the 50 individual US states has its own set of laws regarding unlawful possession of a controlled substance. For instance, Kentucky's criminal statutes (KRS - Kentucky Revised Statutes) regarding unlawful possession of a controlled substance are codified under KRS 218A.1416(1), which provides: "[a] person is guilty of possession of a controlled substance in the second degree when he knowingly and unlawfully possesses a controlled substance classified as Schedule I or II which is not a narcotic drug; or specified in KRS 218A. Adderall is in fact a Schedule II drug and, because it is not specified as an opioid under KRS 218A, Adderall is not a narcotic drug. KRS 218A.1416(2)(a) provides that

"[p]ossession of a controlled substance in the second degree is a Class A misdemeanor." So, contrary to the definitive answer of YES given by the criminal justice major, unlawfully possessing Adderall in the Commonwealth of Kentucky IS NOT A FELONY OFFENSE. In fact, the offense is a misdemeanor in the majority of the US states. There are some states, however, such as Louisiana, where possessing Adderall without a valid prescription is a felony offense.

The key factor here is the jurisdiction in which the offense occurred and not, as the criminal justice major inferred, the classification schedule of the particular drug. The Controlled Substance Act (CSA) sets forth a hierarchy of schedules under which certain drugs are classified. Drugs are classified under a particular schedule for factors such as potential for abuse, medicinal usage, legal status, potential for unlawful diversion, etc. Drugs with the most potential for abuse, dependence, diversion, etc., are designated as Schedule I, while Schedules II, III, IV and V include drugs which are progressively less likely to be abused, unlawfully diverted, etc. However, contrary to popular belief, these Schedules do not necessarily define or reflect the severity of criminal offenses associated with unlawful possession, manufacture, trafficking, or other illegal acts involving the drugs classified within a specific schedule. Although, in general, drugs classified as Schedule I, II and III are often regulated by criminal statutes more stringently than those drugs classified as Schedule IV and V.
