You cannot just take someone's name off a deed. The person owns the property and they must transfer their interest voluntarily by executing a new deed that transfers their interest to a new owner. The only other way to "get someone's name off a deed" is by a court order.

Yes, but you must take your name off the title to the property at the same time by conveying your interest to the co-owner who will refinance in their sole name. All the owners of real property must sign the mortgage.

Yes, the deed is the certificate of ownership. The mortgage is the financial loan instrument. You can't take your name off the mortgage because the bank loaned the money based on your credit.

Can a wife take her marriage license to the courthouse and have her name put on a house deed and have her husbands deceased wifes name taken off?

No, she cannot do that. The deceased wife's name will be removed by the executor upon the presentation of a death certificate. Depending on the law, the wife may be automatically assumed to be on the deed whether it is physically there or not.

How do you remove a dead spouse's name from a house deed in the state of New jersey?

If the property is owned by two as husband and wife (tenants by the entirety), there is no need to change the deed to reflect the fact that only the survivor owns the property. Common practice in NJ is to do nothing in the way of changing the deed. However; if for some reason the surviving spouse still wants the decedent's name off the deed, he/she would sign a new deed by herself as the sole surviving owner conveying the property to herself as sole owner. At that point only the survivor's name is on the deed. Names are never "taken off deeds" to reflect that a former joint owner is no longer an owner. A new deed is created to do this.

If my 80 yr old dad's name is removed from deed in October 2003 and nursing home is possibility can house be taken?

The house would not be taken if the payments are up to date or it is owned by him. The deed can be transferred to whoever he would like it to be transferred to.
