Simply put, you don't. To take over responsibility for someone means to have the legal obligation to do so. The state won't accept a 'voluntary' custody agreement. You can certainly take care of them without official papers, but it does not releive the parents from their obligations.
That is impossible to know without knowing WHY they are involved and all the circumstances. I suggest you ask your lawyer.
No. Custody and visitation rights are completely separate from the problems you two have about the lease. That is something you two have to figure out without getting the child involved.

If your mother has or had legal custody, (and she must have had it to legally transfer it to your sister) then only she could initiate such a proceeding. I'm assuming all of this was done with the approval of the court. If it wasn't, then there's not much you can do without getting child protective services involved and if that happens, everyone might lose custody to the state.

Unless he has a court order that gives him sole custody, yes. She is the one with full custody until he has petitioned the court for it.
You cannot have sole custody without physical custody. If your ex has physical custody, you are the non-custodial parent.
Call the police anonymously.
If a woman gives custody to someone else without informing her husband or getting consent, it is called kidnapping. She could go to prison. She might not like it. On the other hand, she gets three hots and a cot.
