if you and her have been divorced (which is final after 3 months in the Islamic way) and you guys have waited 3 months then she is free to marry another man
the waiting period of 3 months is to make sure that she is not pregnant
but if she is ur wife still and not an ex wife then that marriage is illegal and haram
