Technically yes it is. Because your edited photo required the original in order for you to make your derivation you would be guilty of infringement.

Now as a practical matter the scenario you lay out makes it impossible for you to get caught however we're talking about copyright law here, not practicalities :-)

Is all music copyrighted?

No, not all music is copyrighted. Any music that you hear on the radio or buy on the internet is probably got a copyright on it. The only things that will not have a copyright will be music for which the copyright has expired. The laws have changed, but in general, anything published prior to 1923 has entered the public domain. Anything published since then is likely protected for the life of the creator plus 70 years. And anytime you create something, whether it is a book, or writing, or web page or music, you have a copyright to that item.

Are all photos protected by copyright?

No, but any photos taken since 1923 COULD still be copyrighted, other than those taken by U.S. government employees. Any copyrightable photos taken since the U.S. law changed, in the late 1970s, would still be copyrighted. The good news for you is that the owner of the copyright (especially in old photos) has the burden of proving copyright ownership, if you're infringing, and it is very rare that a licensing settlement cannot be worked out, if it comes to that. Depending upon what is depicted in the photo, there could also be issues of copyright subsisting in the underlying materials, say, where you take a photo of an original painting and sell copies without a license from the painter.

If there is more than one copyright do you go by the newest?

Depends upon what you mean by "go by". If you're trying to determine when a copyright expires, then the original publication date may be a factor for the contents of the original edition and later dates may apply to materials changed or added in later editions. The copyright owner is under no obligation to point out what, if anything, has changed from one edition to another.

Must a copyrighted symbol be displayed to protect the copyrighted?

No. With copyright, you should assume something IS protected, until you have evidence to say otherwise. Copyright applies to something as soon as it is fixed in a tangible form. No (C) symbol is needed.

How can a melody be changed into a variation?

This can only be done by the copyright owner or with the copyright owners written permission. Generally in most songs - there is a 4 bar melody of which the song is known. Anything in the song can be changed - or varied - except this 4 bar melody. So a specific song can have many different melodies and variations - all known by the original 4 bars of which the original song was known.

What does a copyright article look like?

Why do you think the copyright law should be changed?

Current copyright law doesn't have a reasonable balance between the rights of owners and the public good. No provision is made to deal with orphan works, which are becoming increasingly common. Using the fair use defense against infringement charges is a "guilty until proven innocent" situation; fair use should be the assumption, and the onus should be on the owner to prove infringement. Although "willful" infringement is more serious on paper, in practice little or no distinction is made between casual, accidental infringement and intentional, institution, wholesale infringement. Because technological advances have the ability to change the environment so utterly, a complete review of the law should happen every 5 years at a minimum. Most countries are using laws that never anticipated the internet, and trying to apply the same rules to physical and digital materials.
