Make sure the pedal rises back up enough to depress switch under dash.
Brake light switch is broken or needs adjustment.
Check the brake light switch down on the brake pedal.
Break lights come on when you step on the break, they do not come on when the head lights are turned on.

Check the brake light switch.
Check the brake light switch first. It is usually near the brake pedal under the dash. A bad turn signal switch can also cause this if the brake lights are also turn signal lights. If the brake lights are independent of the turn signals then disregard the switch problem. A good wiring diagram will help to diagnose the problem also. Check with dealership mechanics as they have access to diagrams.
Sounds like it sticking from under the brake pedal. Have the brake switch looked at. It may need to be adjusted of replaced.

My mechanic had to change a switch inside the steering column. Brake lights worked when turn signal was on. Have a mechanic check that.
