I'm assuming that your asking from the USA ... other countries have other laws I'm not familiar with ... but I do know that Australia, Canada, England, France, Germany, Switzerland, Israel, Spain, the Philippines, Wales and most other countries in Europe have very similar rights ...

with that being said, let's move on ...

if you are asking can the police question a minor without a parent being present, then the general answer would have to be YES they can

BUT, it also depends on the local laws ... I suggest you look thru your local yellow pages and contact a lawyer and ask them (many lawyers will answer a few questions like this for free) as there are a few states that say no you can't

one thing to note ... (again, this only applies in the USA) make sure your "Miranda Warnings" have been read to you PRIOR to being questioned ... when they ask if you have understood them, say NO ... the police can not ... I repeat CAN NOT continue with their questioning unless you fully understand your rights ...

and don't forget the very first words "you have the right to remain silent" ...

just tell them that you are exercising your "5th Amendment Rights of the Constitution of the United States ... and that you wish to remain silent"

if push comes to shove, demand a lawyer (one of the rights mentioned ... you have the right to have a lawyer present at any time during questioning)

DHR can ask a minor a question without the parent present because they are not asking the minor if they have committed a crime but if the child has been abused. If the parent is present then the child can become unreliable and an abused child will be scarred to say if they have been abused especially if the abuser may be a parent, relative, or sibling. DHR worker are cautioned in sexual abuse cases to not to interview the child child anymore than they have to . This is the reason Children Advocacy Centers have been set up so the child does not feel like an inmate and if prosecution of a parent in a sex case case be be properly documented.
