You have to file a suit for dissolution of marriage, on specific matrimonial grounds including (Khulla), in the Family Court of Pakistan. The divorce decree will be sent to the concerned union council for issuance of divorce effectiveness certificate. A divorce decree and certificate issued in Pakistan will be recognized in Canada.

Go to an idarah (Muslim Court) and apply for a khulla (Islam gives the right for a female to divorce) but you will need to have a your nikah naamah (marriage certificate) they will then contact the court in Pakistan where your marriage is registered and from then contact your husband if he refuses to get in touch after 3 times then divorce will automatically happen Hope this helps :)

Answer What I know about divorce papers is that they require two signatures, one from you the other from your husband, and if he doesn't sign the divorce papers, it doesn't matter he is no longer in the State where you live, if he doesn't sign the papers you can't get your divorce. There is also common law marriages where two people can live together for as long as they want and divorced or not, you can still live with another man. There's no law against it.
