I recvd a granishment on an employees wages- the judgement was filed 7 years ago, is this past SOL ?
In the state of Kansas, a civil judgment lasts 7 years. However, a judgment can be extended if it is re-opened in court before the 7 year deadline.
A creditor cannot garnish your wages unless they file a lawsuit and obtained a judgment against you. The time deadline to file a lawsuit will vary by state.
The tricky thing about credit cards is that they never expire so no matter how old it is, they can call it in for collection now and put a lien on your home. If the debt is still active, then it can be on your credit report as well. It has to be settled in order for it to go the full 7 years and dissappear from your record.
Generally, yes. In most cases, civil judgments are valid for 10 years, and can even be renewed beyond that.
