If you are getting text messages too late I would recommend turning your phone off. If you need your phone for an alarm i would recommend setting your phone to alarm only, that way you can still be woken up by your alarm but you won't be answering text messages too late.
A website called brickhouse security has a product that works with all phones with a sim card. Its a USB device that reads the sim card. Doesnt matter if he/she tried to delete them if they arent overwritten then you can read the deleted text messages. The product is around $150
