I do HR and NO you cannot go to school on FMLA MMLA SMLA are all meant for a UnPaid leave if u have Maternity, your mom sick or your sick. Legally if its a Leave that you Asked for Put in writing and it was Approved you have up to 8 weeks were the employer has to keep your same postion hours ,schedule , shift ALL of it. 1 day of 8th week up until the 12 week they have to give u aposition so u can go from full time days to part time nites and after 12 weeks Employee terminates own position
Possibly. While the FMLA only gives you time off work and it does not entitle you to wages, you dp have the right to request that you receive any vacation pay or sick leave pay if you have any accrued.
As long as there is a VALID MEDICAL reason.
To qualify for FMLA leave, you must be INCAPACITATED, not just feeling puny. You must be incapacitated from attending school, going to work, or caring for yourself. If I, the employer, find that you are capable of working for someone, I withdraw your FMLA grant.
Do not understand what the phrase "backup" is referring to. However - FMLA guarantees that you will be able to collect the pay you may have coming to you (via accrued vacation/comp time/sick leave), and guarantees your position, for the length of the FMLA absence.
You are on FMLA leave as long as a doctor says you remain "incapacitated from working, attending school, or caring for yourself" ... until 12 weeks runs out. So, if you ARE still incapacitated from those few things, nothing says you can't go to Disneyland or COzumel.
Can you receive unemployment benefit after your fmla runs out
No. FMLA clearly states "Covered employers must grant an eligible employee up to a total of 12 workweeks of unpaidleave during any 12-month period..."
I was injured on the job but did not miss work. Must I file for FMLA?
You can't be disciplined or discharged while on FMLA, but can be on your first day back.
There is no "committee." The FMLA (Family Medical Leave Act) is a public law.

If you are receiving FMLA benefits, you are still employed. Unemployment is for people that are not employed, therefore you would not be eligible for benefits. You would have to wait until your FMLA and any other possible leave is exhausted before applying for unemployment. However, if you are still not able to work after your benefits are exhausted or caring for someone and not available to work, then you could be denied based on those factors. Correct. FMLA leaev is only for those still emepeloyed, but totally incapacitated from working by their med condition or the relative's condition. Folks totally incapacitated from working can never get unemployment benefits.
