Not in NY state. Others may be different. Check at your DMV.
From what I have read, no, a underwriter cannot stipulate who goes on the title if the loan is in more than one person's name. Normally, both names that are on a loan have to go on the title of the purchase from the loan.
The lender will probably insist that all names on the title also be on the loan, but not the other way around.
My wife and l bought a condo and it is in both our names but the loan is only in my name We just bought a house but the mortgage loan is only on my name. The title and deed is is both our names.
You can cosign but both names will be on title.
yes
The car goes back regardless. If BOTH of the two people are on the loan, then BOTH are responsible. But if only one is on the loan then ONLY that person is reponsible.
Not without refinancing the existing loan and changing the names on the title to the property..
The car loan has nothing to do with ownership. It all comes down to who's name is on the title. If only one name is on the title, that name controls the vehicle. If both of you are on the title, you'll have to come to some type of agreement on your own. You may try to seek legal advice from a local attorney. State laws vary as to ownership rights. Keep in mind, If both names are on the car loan, you're both responsible for the repayment of the loan regardless of who has possession of the vehicle. Good luck!
Depends on wheter both your names are on the title or not.
I'm not sure if it varies from state to state, but we were able to do that. The mortgage is in my husband's name, yet both of our names appear on the deed.
No. The state has you both on the car so you both have equal rights to it regardless of who signed it. Depends on how it is titled. If it is Joe AND Mary, they must both sign and the title loan company would not have given a loan without both signatures. If it is Joe OR Mary, either of them may sell (or lose) the car without the other's signature A contributing factor will also be if the vehicle is titled to a married couple and said couple live in a community property state.
In order to refinance even in one persons name, anyone else who is on title must be present at closing. You can't legally refinance a home unless all people on title are present at closing. In any case names on a loan do not directly reflect names on title, you can have one person on a loan and 5 people on title.
