Yeah. All court orders have to be followed. If he/she doesn't want to go, paperwork needs to be filed and the order amended. Judges can impose contempt of court rulings. However; it should've stated in the visitation stipulation that the child adhere to court order until a certain age or circumstance. Good Luck. Child custody is one of the most painful, excruciating things a person can go through.

How old does a child need to be to decide she does not want to go with her dad in Michigan?

Children do not decide with whom they will live or whether or not they will adhere to visitation requirements. If there is a conflict relating to custodial issues a judge may interview the minor child as to his or her preference or not, it is entirely at the judge's discretion. In regards to visitation, if it is court ordered the terms of the visitation order must be obeyed or the custodial parent will be in contempt of a court order. If there are mitigating circumstances involved, for example if the custodial parent believes visitation would place the child in an unsuitable/dangerous position, he or she should petition the court for revocation or amendment of the original visitation order.

Can a 16 year old refuse to see parent for visitation in wisconsin?

Assuming the visitation is court ordered, then no. If there is a legitimate reason the minor does not want to spend time with the parent (ie they're a drug abuse), then the custodial parent needs to petition the court for a modification of the visitation order.

Can a child at 11 years old have a say to not want to se his farther?

The child is always free to express their wishes, either in court or by writing a letter to the judge in charge of their custody/visitation. If the judge feels the child provides valid reasons why they no longer wish to visit their father, the visitation order may be modified. However, court ordered visitation must continue until that happens, if it happens. Otherwise, the mother could be found in contempt of court and fined or even jailed for their child's failure to obey court ordered visitation.

Does a 16 yr old have to go on visitation visits in Oklahoma?

I would think that depends on what the court has ordered. However - in my oppinnion, a 16-year-old should be mature enough to decide for themselves whether they want to go on visitation visits or not !

Can a 15 year old daughter opt out of overnight visitation in Massachusetts Her 41 year old father recently moved into a 3 bedroom apartment with HIS father and brother She will not have her own room?

A child does not have the right to ignore a court ordered visitation schedule. A parent who assists the child would be in contempt of court. The parents can agree to modify the schedule as the situation requires. If the parents cannot agree, the visitation schedule stands unless modified by the court. A private bedroom is not a requirement for overnight visitation, nor is a home without extended family.

What options does a 17-year-old have if he doesn't want to participate in court ordered visitation with a parent?

unless the father is abusing the 17yr old physically or emotionally then there isn't much of a choice. Court order visitation is mandatory unless the parent with visitation relinquishes his or her right to do so. The option is for the custodial parent to file a petition on behalf of the minor requesting the visitation order be amended or rescinded. A 17-year-old would be given the opportunity to present reasons for the request to the judge, likewise, the parent who holds visitation rights would be allowed to file an objection.

Can an almost 16-year-old visit his non-custodial father when he feels like it and not on a set schedule now that he is older?

If Dad has court-ordered visitation set up on a certain schedule then that has to be followed unless Dad agrees to forgo his visitation.

Do you have to pay child support if your ex has had physical custody of your 16-year-old daughter for 4 years and you have had no visitation and your daughter has refused contact with you for 4 years?

Yes, if there is an active support order in place the obligated parent must adhere to the terms or risk being found in contempt of a court order. Child support and visitation are two completely different issues and the non compliance of a custodial parent to allow the other parent visitation has no bearing on the child support obligation. A parent who wishes to have contact with their children and is not able to do so, should consult with qualified legal counsel or agency for assistance in obtaining an order of visitation, compliance to an order of visitation, domestic mediation on the matter or other available options.

Can a 15 yr old decide not to visit non custodial parent on a bi weekly basis?

Not if the 15 year old lives in the United States. The minor must reach the age of majority (18 at least in most states) before they can make such a decision without court permission. However, a younger child is always free to express their wishes, either in court or by writing a letter to the judge in charge of their custody/visitation. If the judge feels the child provides valid reasons why they no longer wish to visit their parent, the visitation order may be modified.Otherwise, court ordered visitation must continue until that happens, if it happens, or the custodial parent could be found in contempt of court and fined or even jailed for their child's failure to obey court ordered visitation.

How old does a child have to be in the state of west Virginia to refuse to see the non custodial parent?

18. However if the child has a valid and compelling reason why they do not wish to abide by court ordered visitation, they have the right to make their wishes known to the court, either by writing a letter to the judge, or engaging a guardian ad litem or an attorney to petition the court on their behalf to express their wishes. The judge will take them into consideration and may make a modification to the existing visitation order based on the same. In the interim, it would be in the best interests of the child to adhere to court ordered visitation as well as in the best interests of the custodial parent. Otherwise, that parent may be held in contempt of court and fined/jailed for non-compliance. If the contempt becomes chronic, the judge may modify the existing custody order in favor of the non-custodial parent.

Does my 14 year old in GA have to visit his other parent if he doesn't want to?

If the parent has court-ordered visitation, yes. If there is a legitimate reason the child does not want to visit the parent, the custodial parent can petition the court to revise the visitation order. Be aware the court will not deny a parent the right to visitation without a very good reason, nor will they look kindly on a custodial parent who request it without a very good reason.

Does a 16 year old daughter have to visit the father?

A 16 year old girl does not want any over night visitation with her father does she have to go? *** If they live in the US and Dad has court-ordered visitation, she has to go. If there is a legitimate reason that she doesn't want to go (he's abusive, a drug user, etc), then the custodial parent can go back to court and request that the visitation order be modified. However, without a legitimate reason, the court will not deny a parent the right to visit/maintain a relationship with their child.
