Simple, the title holder, provided the title is in that person's name. Possession may be 9/10ths of the law, but possession is only possession. Ownership is another matter. If you have a title in your name, and someone else has your car and will not give it back-- well, you cannot steal your own property. Just don't enter a structure to get it.
You may do that, only if their is a lot of money or medium type of money... because if their is not much money and you have to give that amount of money again. Then you can SUE that person hard.
Why would you buy a vehicle from someone who does not have clear title? Take the vehicle back to the person who had no right to sell it in the first place and get your money back. They did not meet all the terms of the contract in that they failed to provide clear title; therefore, the contract of purchase and sale is null and void. Next time ensure that the person who is selling you a vehicle, actually owns the vehicle. Good Lord!

On the back of the title there is a place to sign it and the person that is receiving the car signs it as well.
Take your title back to the DMV, and have a new on printed. Basically, you need to re-title your vehicle, but if the mistake is proven not your fault, it should be at no cost to you.

States vary on the design of their titles, but I think this applies to all, at least all the states I've come across. The person on the front of the title can sign the back of the title it the top portion to transfer the car to another person. It must be signed the same way it reads on the front. If a middle initial is used, it must be on the back also. The other spaces on the back are for Dealers Only. They should be marked as such. If the person on the front has signed it over to you on the back correctly, you can sign it over to a dealer, but not another person. You have to run the title in your name first and then do it.
An open title on a used car is when someone skips an assignment on the back of the title. This can create many problems. You want to make sure that the car you are buying has a clear title. A Clear Title means there are no issues with the title.
