The couple should contact an Immigration lawyer. If an illegal alien is in this country for more than one year, then they are subject to a 10 year bar from ever intering USA agin. The couple should hire a lawyer to help with the process of filing the required forms, and the illegal will have to then return home to his/her country and wiat for an interview at the American Consulate. This is a process, and the bar can be waived if spouse files for a petition. The illegal will have to remain in home country for 30-45 days and wait for the approval of the petition. If approved the illegal will then receive his/her green card. If denied they will be subject to the ten year bar. Nothing is guaranteed in this process, and any convictions of a felony or misdemeanor will be a disadvantage to this person.

∙ 15y agoThe illegal alien should take his wife and children and to his country of origin. There his wife and children may obtain citizenship, but according to U.S. law he is not even eligible to receive a visa to the United States once he leaves the country for 10 years. There is little hope of him ever gaining legal status after abiding illegally within the U.S. for so many years.

∙ 11y agoUnless the child was born in the US they must return to their home country before turning 18 1/2. After 18 1/2 they are no longer considered a minor and being here illegally will be held against them by US Immigration. Then re-enter legally and apply for citizenship.
If the child of illegal immigrants where born in the United States they are legal citizens of the United States and at the age of 18 years old can sponsor the parents or siblings to become U.S. Citizens

All he needs to do is to obtain a Mexican Passport at the nearest Mexican Consulate and take this with you when you obtain your marriage license. My husband and I had gotten married on the same day. However, I will advise that you carefully consider the consequences and take the advice of someone who has done this. Unless you are willing to reside in Mexico, don't get married!! After nearly 8 years of being married, my husband still cannot obtain permanent residency even though he had returned to his country while I went throught the entire two year process, not to mention a costly one, of petitioning for his return only to be denied.
