Your Green Card is valid even if you get the divorce. However, you cannot apply for citizenship within three years of obtaining the Green Card, but you have to wait for five years. You can also call 1 800 375 5283 and speak with a customer service represetntative about this.

No. Generally a marriage between a US citizen and a foreign national illegal or not would be considered valid. However, in situations where the foreign national has been deported and reentered against US Immigration laws a marriage to a citizen would not be legal. The non citizen spouse is unlawfully present in the US and is now subject to incarceration as well as permanent deportation. If the marriage was one fraudulently entered into both parties have committed a violation of federal law and both can be charged with a criminal felony. *The marriage was not fradulent by no means. And I was told that as long as we have a valid license and it is recorded by the state we married in then all is GOOD. And even Mexico acknowledges marriages that have taken place in the United States. So where is the problem? Illegal immigrants get married everyday in the Unites States. They did not ask us when we were getting married if he was illegal or not or if he had been deported. Yes, but you will need to get a lawyer to help you file, since with the deportation you case is a little complicated. you will need to file a "waiver" to excuse your re entry, and this is the complicated part. that is why you will need a lawyer to walk you through it, good luck

Yes you can keep the green card. For any name change you should use the Form I-90 and get a replacement with new name.

yes, if there is a divorce before the removal of condition, then the petition you entered on would be denied- meaning that you would have to leave the country or stay and risk deportation.

Can you still stay in the country if you have your green card and are married to a us citizen and have a child and are getting a divorce?

Individuals who obtain a Green Card through marriage to a U.S. Citizen are granted "Conditional" Green Card status, which is only valid for two years. Individuals who have been granted Conditional Green Card Status are required to apply to remove the Conditions on their Green Card within 90 days of the date that their Conditional Permanent Resident status expires that is within their second anniversary and they are still married.

I want to divorce my immigrant husband?

As a U.S. citizen, you would divorce your immigrant husband in exactly the same way that you would divorce a spouse if he was a citizen. I am not sure from your question, but if your husband's green card status is still pending, then divorcing him during the process will affect this application. If your husband was granted a conditional green card, his permanent residence privileges may be revoked if he is divorced within two years from the date this status was granted.

Do i need divorce documents from my previous husband in another country before i marry a US citizen?

I would consult with the Embassy in the country you are now residiing if living in a foreign country. In the US, you would still be considered married until a Divorce Decree is documented in the court systems.

A wife is a citizen and she marry an immigrant is her husband now a citizen?

No. If he was illegal before, he's still illegal. He will need to go through the system to seek a green card. If he already has violated U.S. laws, he may never be able to seek citizenship.
