The rear lights of your car will still on even if your car was off because the switch was turned on and it will still remain on until the battery's out. It could be a combination of two simple problems. First, check that your parking light switch on the top of your steering column is OFF, as this will keep the lights on even if the ignition switch is off. Look under the dash on the driver's side, half way down the brake pedal. When you depress the brake pedal, the pedal moves away from this switch, which allows the brake light pedal circuit to complete, and your brake lights come on. This brake light switch is always hot/on, as required by federal law, so that even with no key in the ignition, if you hit your brake pedal, the brake lights will come on.
the brake lights are on a separate cuircut,if your brake lights are staying then it will be a fault with the brake light switch. the switch is located under dash,and will be on or very close to brake pedal.
