Texas Penal Code § 16.02: So long as a wire, oral or electronic communication - including the radio portion of any cordless telephone call - is not recorded for a criminal or tortious purpose, anyone who is a party to the communication, or who has the consent of a party, can lawfully record the communication and disclose its contents. While Texas is a one-party state, if you record a conversation without notice in which the other party is in a two party state, you can be prosecuted by that state.

No, Connecticut law requires two-party consent, which means that both parties to the call must be notified and give consent for the call to be recorded. 11 other states have similar restrictions. They are: California, Michigan, Massachusetts, Pennsylvania, Washington, Florida, Delaware, Montana, New Hampshire, Illinois and Maryland.

In the remaining 38 states, one party notification/consent is typically enough.

Oklahoma does, indeed, have a one-party consent tape recording law. HOWEVER it only applies to IN-STATE phone calls. If the call is from (or to) an OUT-OF-STATE party, federal law prevails (ALL parties to the call must consent).

It is a federal law to record telephone messages without one party consent. There are 12 states who do two-party consent, which means all people must have knowledge of the recording. A one-party consent means only one person has to has knowledge and give consent to the recording. Oklahoma is a one-party consent state.

It may depend on what state you and/or the other person is in. With few exceptions it is not. To be safe, as a general rule it is NOT lawful.

Is it illegal to record a phone conversation between two different people in Oklahoma?

There are 2 different opinions here...ANSWER 1:No it is not, as long as the person recording is a party to the conversation. ANSWER 2:I was just searching & reviewing the laws for Oklahoma last week, concerning whether it's legal to secretly (or without all parties knowledge) record a conversation. I do know that in Oklahoma only 1 party of the conversation needs to consent to the recording, if it is a face to face conversation. However, if over the telephone, I'm real sure that all parties of the conversation have to formed at the beginning of recording.See Oklahoma Statutes Annotated, Title 13, § 176.4(5)

How does one get a cellphone to tap?

Cellphone tapping has numerous privacy and subsequently ethical issues attached to it. In many instances, that are not government-based (lawful interception), it is an illegal act and should not be encouraged. Phone recording software can be used to record a call or text conversation, as can coil taps attached to the headset, and some poorly protected calls can even be monitored via a simple radio scanner.
