Difficult as it is to believe Virginia is one of the few states which still have existing cohabitation laws and sometimes enforce them. Virginia Code 18.2-345 makes the living together of unmarried persons a Class 3 misdemeanor for a first offense and if the offense is repeated it becomes a Class 1. If someone chose to make trouble it is quite possible they could alert authorities to the situation. It is not possible to predict exactly what action authorities might take if any. No, there are no laws in Virginia that makes it illegal for a custodial parent to live with their boyfriend or girlfriend. If you feel you child is unsafe in this situation, you will have to pursue custody through the courts.

I assume that the "ex-boyfriend" is also the father of the child. If you believe that he lied to gain custody, you can file a motion/petition for a custody re-hearing and be prepared to demonstrate that he lied, and that you are a 'fit' mother to have custody of the child.

In the US, no, you can't gain custody merely because you don't like your ex's new boyfriend/girlfriend. However if that boyfriend/girlfriend is unfit/ presents a danger to the child, that's a totally different situation.
