I believe (at least in the state of Pennsylvania) that the employer would not be liable. I looked up the answer in an Insurance book that I have for PA. And actually, it was in the liability EXCLUSIONS: "for any insured using any vehicle while employed or engaged in any business, except for farming or ranching". Therefore, I think that the damage would not even be covered. It would be covered if not being used for business, but the employer would not be liable for the damage. I know that auto insurance follows the car, so if you made a claim, you would have to make it on your own auto policy. Hopefully you were able to make the comprehensive claim! Hope I helped a little!

What are the liabilities for employees that drive on company time in their own vehicle?

Your employer's auto policy may cover the company but not you, so you could be sued and your personal auto policy may not be enough to cover the claim. You don't pass the liability to your employer, and you may pay higher premiums because you're using your personal vehicle for commercial or business purposes.

You cannot use an EIN unless you are using it for legitimate business purposes. The use of an EIN to obtain credit for personal purposes is prohibited by federal law. If you are an employer and have applied for and received an EIN, you can use it when applying for business credit, or when filing business tax returns.

Can your employer force you to put the company name on your auto insurance if you drive your personal vehicle to do company business?

If the employer is compensating you for the use of your truck, i.e, a mileage rate, then yes they can ask to be listed as an additional insured. However, if they fail to pay you anything for the use of your vehicle, they have no right to demand anything regarding your vehicle. It should also be noted that if you have an accident while in the performance of your employment, they are ultimately liable. Make sure you inform your carrier that you are using the truck for their work - then watch your rates go through the roof.

For a small business, what are the benefits of opening a business checking account rather than using a personal checking account?

There are several benefits from opening and maintaining a business checking account rather than using your personal checking account. When you use a business checking account you are segregating your business funds from your personal funds, thus creating better organization for your business. Also, having the business checking account will help at tax time because all your business transactions will be within the business checking account and there will be no need to sort through your personal transactions. Finally, the business checking account will allow you to use a taxpayer identification number (TIN) so the funds can legally be owned by your business, instead of using your social security number on the checking account. For a small business, opening a business checking account allows you to get more interests. In addition, transactions are processed faster compared to a personal account.
