Well, who do you want to get your property if you die unexpectedly? If she is not on the deed then you should make certain you execute a will if you want the property to be hers if you die. Otherwise title will pass according to the laws of intestacy of your state and your wife may not inherit all the interest in the property.

Is a joint mortgage needed for joint ownership?

Not necisarily. If you are married and the house was bought after the marriage then no. If you are married and the house was bought before the marriage and the person that did not originaly buy the house made one payment on it or you had a joint account that the payments came out of, then they are half owner. If you are just living together with no marriage, then the house it the person's that bought it, but you have to be carful of common law marriage.

If you legally buy your husband out of your mortgage and change your will can he still be entitled to claim anything before your divorce?

This depends what other assets you may have.Added: You say that you bought him out of the mortgage - but you don't mention anything about how the property is TITLED or DEEDED. If you die while he is still married to you and is still on the title and/or deed, he may be entitled to the property depending on how it is titled in your state.

Can a married woman retake property that her husband bought and then gave away after they were married?

Was this property bought before or after marriage? Either way, if you are married and want to sell real estate or a car or such, both spouses have to sign their consent to the transaction. So if your husband sold something behind your back, you might have a case. If it was bought before that, there's room for argument.

Is it a good idea to buy a bank note for your own property from someone who has bought it from the bank?

That could be done. However, you should seek the assistance of an attorney to determine that the assignment of the note from the original lender to the person who claims to have bought it is bonafide. The assignment of the note and mortgage from the bank to the present holder should be in writing, with reference to the recording information of the mortgage and signed by an authorized bank officer. The note and mortgage should then be assigned to you in writing, and in a similar form, upon payment to that assignee. Both of the assignments should be recorded in the land records. The second assignment, to you, should extinguish the mortgage lien on your property if you are still the record owner of the property.
