Not quite sure what you mean by "capitalizing" the Fifth Amendment rights. There have been recent acts of outrageously unconstitutional grabs of money by the Obama administration of BP funds. More of an extortion. And this act being perpetrated on a foreign-owned company.
The recent passage of the Health Care reform bill will bring all of this into question once again, with it's requirement for American citizens to buy into the plan, against their wish.
Violation of these constitutional rights is setting a very dangerous precedent, and cannot be tolerated. Checks and balances built into the United States Constitution and due process of law is the one thing that separates us from being overrun by a Dictatorship. The authors of the constitution showed intelligence and incredible foresight in writing this constitution for YOUR own good, giving you true freedom. It should be guarded jealously at all times.
