The emergency or parking brake has absolutely nothing to do with transmission levels. The reason the manual states to park with brake applied is for safety reasons - should the vehicle lunge forward or backwards while you are checking the fluid level, you might be injured.

Checking the transmission level when engine is cold WILL give you the false reading. Tranny fluid level MUST be checked with engine at normal operating temperature (usually after being driven 5 to 10 miles) and idling in Park. Overfilling the transmission is just as harmful as not having enough fluid.

Q: Transmission fluid no marking while in park and hot but is at overfil marking cold i added 3 quarts already manual says park with emergency brake but emergency break doesnt work is it a false reading?

TAke the trand pan off and change the filter while you are there. Refill it with about 3 quarts then check it. Don't overfil it. Dispose of old fluid correctly. Most parts houses will take it . there should be a small pan attached to the bottom, now on the pan should be a small bolt, if not on pan look along both sides of the trany. when u find bolt remove it. it is a smart thing to change the trany filter too, remove the pan to do this.

Take off the front tire look at the back side of the caliper to see what type of bolts hold the caliper in place get your wrench and remove the two bolts holding the caliper in place. now you may have to pry or hit with a hammer to get it loose then take out the old pads, and use a clamp to push the plunger back in (you may want to open the bleeder valve when doing this to let out the fluid as you push the plunger back in, other wise the fluid will overfil the resovoir above.) put in new pads and reinstall. be sure to pump your brakes before you go anywhere to insure a good pedal feel. If pedal feels spongy you may need to bleed the lines.

Hi mate had same problem a few months ago. It is located behind front near side (Where_do_you_put_the_gearbox_fluid_in_a_vw_golf_mk4) wheel trim on the side of the gear box. It is a round plug with a quite large alen key fitting. You have to put the car on axel stands on level ground. Remove the n/s wheel and plastic wheel arch liner to see the gear box filling plug. Remove the plug with an alen key (maybe 8 or 10mm) and fill with gearbox oil until it is level with bottom threads of the plug (do not overfil).Has your gearbox lost all of it's oil? are the gears noisey or whirring at Where_do_you_put_the_gearbox_fluid_in_a_vw_golf_mk4? Is your clutch slipping? cos it could be that you have a hole in your gearbox (very common problem on mk4's ) If it has done more than 60k and your gearbox number starts DUU or DUW (can be located on white sticker near spare wheel or top of gearbox behind green/black inspection plug) then i would wager the gearbox has a hole in it!
