Ancient Roman laws concerning the structure of a central government were certainly known by the US Founding Fathers. Although the balances of power within the days of the early Roman republic had its flaws, the concept of elected officials and of what a republic is in general appealed to the men who framed the US Constitution. They saw the advantages of balancing central government powers, over what at the time were monarchies in the Europe they had left behind.

One outstanding contribution was that in the Roman Republic, there was no room for a "king". The ancient Romans held on to the "no king concept " for centuries.

The American Revolution also was based on not having a king rule the new government that would be formed when American independence became a reality.

What is the most enduring contribution of rome?

Some of the early strengths of ancient Rome was its citizen military. Land owners in ancient Rome were recruited into the legions for the purpose of defending Rome. A citizen army has a large stake in the outcomes of battles and wars as their own families and their property were at stake. Another strength was ancient Rome's legal system. It made the Roman laws fair by having many of the key laws in writing. This made enforcing the laws by judges less subjective as unlike before all Romans could read the laws.

Who wrote the ancient roman laws?

During the Monarchy the king made the laws. At the beginning of the Republic legislation was proposed by the consuls and voted on by the assemblies. The lex Canuleia of 445 BC marked the beginning of the issuing of laws by the tribunes of the plebeians, who eventually issued most of the laws. In 287 BC, plebiscites, deliberations of the plebeian council, were given the force of law and were applicable to the whole of the Roman people (populus). Initially, these applied only to the plebeians. Praetors, who were like chief justices, could issue edicts to amend laws so as correct and supplement them. Over time, the amendments effectively became like new laws and they created a praetoric body of law parallel to civil law. Eventually, the two were fused into the famous Corpus Juris Civilis. The Senate passed decrees called senatus consulta, as "advice" to a magistrate which did not have legal force, but were usually followed. A law passed by an assembly overrode the senate's consultum if it conflicted with it because the latter's authority was based on precedent and not on law. With the empire, the power of the assemblies was transferred to the senate and the senatus consulta acquired the force of law. The emperor was also a law maker. As the Romans started to apply scientific methods of juridical matters, the treatises of professional jurists became very influential.

How was Law used in Rome?

Written laws were a milestone for ancient Rome. Few ancient civilizations had the extent and purpose of written laws as did the ancient Roman republic and later when Roman government was for the most part dominated by an unelected emperor with no enforceable method of legal succession.A Roman citizen had certain rights not granted to citizens of previous major civilizations. Law was used as a method to do its best to recognize that the common citizen could look to a definite, written and secular legal system. Over the long duration of Rome as a simple city state to a decaying vast empire, naturally new laws were created or modified. Some laws were abolished. One major aspect of Roman laws was that certain official offices required an election by the citizens. The beginnings of the Roman system of laws and government were Twelve Tables of basic laws administered by magistrates.
