Family court decides whether to enforce visitation or not. If your kids don't want to see one parent then the other parent can try to tell the judge why they shouldn't have to, and the parent that wants visitation can try to tell the judge why they should. It gets ugly. Kids don't benefit. The whole thing is a mess but in most states kids don't have a choice and even if they go to court the judge doesn't usually listen to them - they think their brainwashed by the parent who doesn't want the kids to have to go see the ex.
Only Indiana and Texas has laws setting out a specific age at which a child can make a choice the court is requiredto abide by, and even than there are some limitations. With those states, it is age 14. In all other states, the general rule of thumb is that a 12 year old can express and opinion, however the judge is under not legal obligation to consider, or even hear it. In either case, a motion to the court must be filed for a determination to be made. However, the child should be informed that there are alternatives to choosing to live with just one parent. The child should also be advised they can express a choice that they remain in one home and each parent can live with them for a designated period of time, than switch. This is called Bird Nest Custody.
Check link below for more info.In most jurisdictions a child cannot make that choice until they reach 18 years of age. Some courts allow older children to express their desires to the judge but the judge is under no obligation to grant their wishes. Children will often desire to live with a more permissive parent. A decision will be made that the court decides is in the best interest of the child.
