For 50cc or lower IF it qualifies as a moped...some do, some don't and the approved list is online too at DMV..then you take a written test and can get a moped license at age 15. Anyone with a reg. drivers license can also ride a moped. If the 50 cc does not qualify as a moped or is larger than 50cc, you need a motorcycle license which is just an M on your regular drivers license. Almost everyone gets this by taking a motorcycle safety course, then taking the written motorcycle test at DMV. An Aprilia 50 cc does not qualify as a moped, but the Honda Metro 50cc does in Texas. The driving rules that apply are the same for both cars and scooters with one exception: Mopeds can use bike lanes. It would not be legal to ride on sidewalks, but then it isn't legal for bicycles to ride on sidewalks either. Texas defines a moped as a motorized vehicle no larger than 50cc capable of speeds no greater than 30 mph. For this reason many 50cc scooters are restricted. The dealer can de-restrict the scooter to make it go a little faster. The Aprilia 50 goes 42 mph. Here's a general rule on speeds: 50 ccs go 25-40 mph (although the Aprilia RS50 goes 50 mph), 125 cc scooters go 55-60 mph, 150cc about 65mph. 250cc scooters go 70-80 mph. The old vintage mopeds that are chain driven only go about 25 mph. All motorized vehicles require license plates. Mopeds have a little sticker added to the plate. You must carry liability insurance as a minimum too and the cost of the title and registration is the same for all scooters, mopeds, motorcycles.
