That can be answered a few ways. In a democracy it is the people, indirectly, who determine the legitimacy of the government. In the US it is the supreme court that determines the constitutionality of laws enacted by congress. In other countries they have courts and oversight committees or government bodies that determine the legitimacy of the acts of the other government branches. In dictatorial countries it is the government itself that determines whether or not what it does is legal,( obviously it never decides against itself).
On the world stage there are several groups supported by the majority of countries that determine the legitimacy of other countries actions. The World Trade Organization, The World Court, NATO, OAS and the United Nations among others also have means of determining legitimate acts of other nations.
legitimacy
governments and laws derive their legitimacy form the consent of the people.
Legitimacy is a term used by governments to recognize another regime. A government can obtain legitimacy in several ways. For example, allowing people to participate in government having representatives shows signs of legitimacy. Also, having a codified law that is referred to shows signs of a "higher law" which is another way to obtain legitimacy.
Democratic governments get their power from the people who vote them in. Legitimacy is conferred upon them only by those they govern and it can be taken away by those same people.

Thoreau means that government is a necessary evil but in practice many governments are ineffective or counterproductive. He argues that people should question the legitimacy of government actions when they contradict moral principles or individual conscience. Thoreau emphasizes the importance of individual judgment and civil disobedience in holding government accountable.
Legitimacy refers to the perception or recognition that an individual or institution has the right to govern or make decisions. Authority is the actual power or ability to enforce decisions or actions. Legitimacy provides the moral and ethical foundation for authority to be accepted by others.
