Auto insurance follows the vehicle primarily, not the person. The problem is going to be that I will guaranty that the person is not listed as a driver on the insurance policy for the car he was in. Most likely, the company will pay your claim with no problem as long as you don't appear to be looking for more than your actual damages. The could determine that the policy owner committed material misrepresentation by not listing drivers and deny the coverage to the person. This would leave you with suing the person who owned the car and the driver yourself to try to collect damages.
they get in jail for not having a licence and driving.
If you have no licence you are driving illegally.Any insurance you may have taken out becomes null & void.Basically you arent insured even if you pay the premiums.Get a licence as you could end up with a law suit if you were to have an accident & hurt someone. As youre breaking the law, you could end up with police on your case too!
You start looking for a good lawyer or a great priest.
You will probably receive a citation for driving while suspended. If you were not at fault for the accident, the other party involved should have insurance that will cover your loss or damage that resulted in the accident. It is a good thing that you were not at fault in this accident.
You will most likely be charged with driving with a suspended licence. The owner of the car u were driving may get in trouble if he knew you did not have a licence and let you drive anyway, however if he didnt know you did not have one then nothing will happen to him. His insurance should (if he has insurance) cover the other guys car and his as well if he had full coverage.
For your safety, wait till the suspension of your driving licence gets revoked. If you are already having a car insurance policy, and your car is entangled into an accident during suspension period, you wont get any insurance claim from the insurance policy. You may also be trapped into police interrogation for driving with a suspended licence.
What are you asking? Have you had a motor accident? Did the other driver have a suspended licence?
If they don't have a licence they won't have valid insurance. Your own insurance company will advise; in the UK there is a pool to cover this, but it'll be different elsewhere.
If, during the precedings, you are picked up your licence then a separate matter will start up.

you woul go to jail.
In the UK, you need a driver's licence to prove you have passed the driving test. You need to pay road tax to entitle you to drive on the road. You need driver's insurance in case you have an accident, or are being sued by a third party.
