They are street legal. There are various "restrictions" in towns though. For instance, in my town, you can ride them, but you have to have a valid drivers license, head light, tail light (reflector), and side reflectors, along with a helmet. But in Springfield, MO, you don't need any of those, maybe its due to the street lights, I don't know, check with your local City Hall to see what you need to have to ride, legally.

as long as it is under 50cc, and can go no faster than 30mph, and has pedals so it can be human powered it is considered a bicycle and does not need to be licensed and you do not need a drivers license or a motor cycle endorsement.

No you don't need a license to drive a 49cc scooter because it is under 50cc and there is currently no law on the 49cc. Until the law changes the only ticket you can get is for reckless driving like standing up with no hands or goofing off.
