Our Fatherland includes SABAH

by Juan Guerra

We have heard the talk in the past about the territory of Sabah, jointly held by Indonesia and Malaysia, and that past governments have desired to bring it into the fold of our beloved Fatherland. However due to the incessant bickering of our political parties no move to reclaim our territory has ever been made, instead idle posturing and saber rattling is all that resulted.

The Samahan will instead pursue a rigorous policy of expansion into the territory of Sabah, not only that our government shall reclaim it, but that it will also be repopulated by Pilipino (Filipino) nationalists. It is intrinsic that once we hold Sabah we must displace the squatter population there and repatriate the entire area with our people in order to hold our claim.

Now many ask does this mean war? Of course not, we are a civilized nation and an intellectual party, which means that though we prepare for the terrible chance of war, in actual fact we wish only for peaceful negotiations. We will work with the Indonesian and Malaysian governments and work out trade deals or financial restitution in return for the land. Yes we know that this land was ours, that we should simply take it by force and damn the consequences. But this makes not only for bad foreign policy but also senseless death of countless Pilipino (Filipino) citizens.

Some claim that because we desire a strong military and that we will fight for the rights of our people that this means our first action will always be war. No my friends peaceful negotiation must always be the first course of action when working with other nations. The fact that Sabah was ours will lend heavy weight to all our negotiations both regionally and internationally, and that will make it easier for us when we work with our allies to come to a final resolution regarding our national sovereignty.

But to what end is the reclaiming of Sabah going to further the Fatherland and our people? Land my friends, it is about living space and breathing room for our national community, land that we need to house and feed our ever-growing population. Instead of facing a nation that will be over crowded and starved for food, with the inclusion of Sabah we will have vast new territories to spread out in and to farm and feed the Fatherland.

With Sabah we will have a drive to the frontiers, land for those without their own, those that live in Manila, the so called "squatters", will be allowed to travel to Sabah and claim land for free as their own from which they can farm and not only feed their families but help feed the nation. This will relieve much of the pressure on Manila and the resources that the city has at their disposal. The poor will be given a chance to create strong and better lives, with aid from our government and a new series of developmental banks that will provide training and funding to build massive tracks of agricultural lands.

OF course we must take precautions ahead of time to protect from slash and burn policies that the Malays and Indonesians have practiced for years. Killing of the natural world, wiping out animals and plant life that may one day yield beneficial harvests in the medical world. Even the pollution from these slash and burn policies have affected the health and well being of our people in the Philippines, the smoke and carcinogens have made their way to our cities causing worse health risks to our nation then were already there.

No for us the inclusion of Sabah is not only going to be a massive economic boon to all our people, to our agricultural industry, but it will also be a huge boost to our national morale helping to spur on the national economy and bringing the standard of living up for our entire nation. Sabah belongs to us; we must take it back as our historical and divine right. The land belongs to us and it is unjust in the best of light that it continues to be used by foreign governments that wrongfully took away our sovereign rights. We will accept nothing short of repatriation to the Fatherland, though we will work with these nations peacefully to achieve such goals.

Brothers the time has come to watch our nation expand well beyond its borders, to what once was the Philippines of the past. Before cowardly imperialists gave away that which was not theirs to begin with to pay of other foreign governments. It is time that these nations made right the wrongs from the past, to pay back what they have taken from us, and it is time for the rest of the world to recognize the sovereign rights of the Fatherland.

How much aid did the US give Chang's nationalist govt in China?

Full military aid: Contemporary US jet fighters, Warships, Tanks, Small Arms, infantry equipment (steel helmets, uniforms, radios, etc.). Nationalist China was "considered" to be a participating ally in the Vietnam War, but that consideration didn't last long...because that particular "participation" would have definitely angered Red China; to the point of their possible entry into the war. Nationalist China was one of the US's strongest allies in Asia. If you look at the websites of all of the US Navy warships (mostly destroyers), looking at their "final dispositions", you'll notice that many of them were sold to Nationalist China.

Why did World War 1 start from the German point of view?

Austria Hungary is a country composed of many different ethnic groups ruled by the duke. Serbia was the country that backed up any nationalist movements by the ethnic groups to break free of Austria. After the Black Hand(a nationalist group) assassinated the Arch Duke and princess of Austria, Austria blamed their neighbor country Serbia because of their support for nationalists inside Austria. When this happened Russia, basically Serbia's big brother figure (in fact, they are closely related because they share allot of the same ethnicity) came to Serbia's aid. Germany, an ally of Serbia, that had been militarizing upto this point backed up Austria in order to "defend its Ally".

Is Sabah Part of Malaysia or in Partner Only?

Malaysia is boasting that Sabah is part of Malaysian Federal Government, which is partly true. This conception is the standpoint of Kuala Lumpur based on the Federal constitution . The Parliament of Federal Malaysia is holding fast on this conjecture due to the inherent participation of Sabah to the Federal Malaysia. Former Sabah Chief Minister Datuk Yong Teck Lee has blown the secret of Sabah's association to Malaysia in saying - SABAH DID NOT JOIN MALAYSIA BUT SABAH IS IN PARTNER TO MALAYSIA.This revelation is the most expounding issue and the only way to find out if Yong Teck Lee is telling the truth is to review the Malaysian Constitution in conjunction with Sabah State Constitution. This two constitution, one Federal in nature and the other one state in nature will give light to the confession of Yong Teck Lee.It was true that Sabah is under the Federal Malaysian Constitution in Pro -Tempore meaning temporary or interim because Sabah State Constitution clearly define that the - STATE OF SABAH CAN INDEPENDENTLY MAKE IT'S OWN LAW as defined under the 20 point agreement. The provision of special applications to Sabah and Sarawak to be exempted from the National Land law of Federal Malaysia seems accurate as per Yong Teck Lee admits that - WE MADE THE FEDERAL MALAYSIA, SABAH IS IN PARTNER TO IT this is a statement of the original people that framed the Federal Malaysian constitution as we see today. The provision of special applications to Sabah and Sarawak is very interesting. If Sabah has freedom over the state land to decide independently, therefore the sovereignty to decide over Sabah belongs to the state. This tell us that there is actually separation of power of two constitutions. State Parliament can make a law to separate and apply the provision of 20 point policy , Sabah can be independent anytime the State Parliament wishes to do so. This could be the reason of edging out the opposition because once the opposition win the majority in the State Parliament, it is likely that a law will be passed to remove the Federal control over Sabah. The Malaysian Constitution is very clear to the provision regarding Sabah and Sarawak, only the Federal function of Taxation , Military and Monetary is the only power that was vested in Federal Malaysia to implement in Sabah. This could be the essence of partnership because Sabah has it's own State Parliament that can act and make laws independent from Federal Laws except that they will be under the Federal laws on Tax,Military and Monetary. The grudge of Sabah State Parliament is the unfair sharing between the State and the Federal, because Sabah is only getting a mere 5% of the revenues that the Federal Government of Malaysia is making out of Sabah. The development and social services is not being address comparing to Peninsular Malaysia. As Datuk Yong Teck Lee admits - WE ARE PAYING A HIGH PRICE BEING A PARTNER TO FEDERAL MALAYSIA which seemingly accurate. The rest of the oppositions is now hell bent in planning to seggregate Sabah from the Federal control if the situation cannot be abated.According to Yong , it is very hard to run the State for a very small portion of revenue while Peninsular Malaysia enjoy the resources they got from Sabah.

What will happen to Malaysia's oppressive occupation of Sabah?

The current position of Malaysia is highly fragile. There is growing concession regarding the oppressive stand of Malaysia against Sabah and neighboring country like Indonesia and the Philippines. Sabah in the first place is not totally Federated to the Peninsular Malaysia but instead Sabah has agreed to be under the partner to the administrative governanace of Malaysia based on 20 point agreement.Malaysian Constitution explicitly stipulates the only three conditions of Peninsular Malaysia duty to sabah . The Monetary, the Military and the Tax imposed to Sabah. The Malaysian Constitution acknowledge the separation of Sabah and Sarawak Constitution and therefore full control over the two territory is limited to Defense , Finance and Tax Rules. The conditional partneship agreed in the 20 point agreement includes - the Freedom of Religion and the separate Land Laws of Sabah. This two point may serve as the basis of conflict. The use of the word "Allah' by the Christian Church is being questioned which resulted in chaotic rage of burning the churches. The Land Laws of Sabah is in total conflict to Federal practice specially the sharing of minerals. Sabah contributes 30% to Federal reserve of Malaysia in terms of profit from mineral exploration particularly oil but the Federal is raking all the money and giving back only 5% royalty to the State of Sabah. The issue of ownership is also like an axe hanging to both State Government and Federal Government. Malaysia cannot proove the hold of Sabah legally and keep ignoring the owner, The Royal Sulu and North Borneo Kingdom of it's plea to return Sabah peacefully like Hongkong. It is just a matter of time that legal justice may arrive upon the intervention of United Nation through it's arm, the International Court of Justice. The expulsion of the natural born citizen is also a big ax since it is already recorded that Malaysia has comitted a mass violation of Human Rights by oppressing the natural born citizen of Sabah. Malaysia is now also facing ethnic rage from Indonesia for promoting the culture of Indonesia as if Malaysian. Students activist are now amassing to 500,000 to protest the stealing of culture from Indonesia and still growing. It was foreseen that anti Malaysia campaign will not abate a the moment due to the growing rage by all sides, including the people of Sabah for lack of social services despite the billions of dollars that Federal Malaysia is getting from Sabah.

Is Sabah part of Malaysia?

Sabah and Sarawak is legally not a part of Federal Malaysia based on conditional partnership they agreed when Peninsular Malaysia become Federated in 1963. The 3 major reason for Sabah and Sarawak to join in partner with Federal is Military , Monetary and Taxation. Sabah and Sarawak has partnered with Federal Malaysia based on 20 point agreement, their own State Constitution separate from Federal Constitution. The 20 point agreement has been forged prior to Sabah and Sarawak association to Federal Malaysia . Being a partner to the Federation does not mean to become a state of Malaysia. This is very clear that separate State of Sabah and Sarawak Constitution is in place. unlike the Peninsular Malaysia that all covers by Federal Constitution. The conditional partnership of Sabah and Sarawak cannot be contituted as full member of the Peninsular Federation of Malaysia.Sabah and Sarawak can at anytime decide if they still want to be a part of the Federal Malaysia through partnership by simply passing a law by the State Government annulling the partnership. This is the point of view by State MP's to segregate because the federal is abusive of the Financial allocation exercise over the two State. Sabah and sarawak combined contribute 60% of Malaysian economy and yet they only receive 5% of the total economic contributions to those two state. Sabah and Sarawak has their own rights, religions and land laws , they pay in return a tribute to Federal Malaysia in return of providing the Military and Monetary by paying excessive Taxation.

What is the proof that Sabah does not belong to Malaysia?

This is the logical proof that Sabah does not belong to Malaysia - Malaysia has manufacture the Cobbold Commission saying that the people of Sabah has wanted to be under them. The fact that the Federal Constitution of Malaysia does not say Sabah is part of Malaysia but under the administrative partnership in governance. All Malaysian Federation has a Sultan but Sabah has none because the Sultan Of Sabah and Sulu are one. If Sabah is part of Malaysia why different system is use not the approved Federal law of Malaysia. It is not clear until today the status of Sabah because Sabah did not join Malaysia ,it was included as a partner to Malaysia as Yong Teck Lee , president of SAPP always point out. The historical Proof that Sabah does not own by Malaysia - way back 1878 Sabah was Leased by a Private British Company ,the lease was transferred to the British Government without the consent of the owner ,The Sultanate of Sulu . In 1963 , the British transferred Sabah to Malaysia again without the consent of the owner. Never you can see in the original "Lease Contract of 1878" that the lease is transferrable nor British Government or Malaysia is mentioned as party or entity to the contract. Malaysia cannot just walk into the contract which was contracted even before they got their independence in 1963 The Legal Proof that Sabah does not belong to Malaysia -- in 1939 ,the high Court of North Borneo has come out with the Ruling that Sabah belongs to the Sultanate of Sulu . The letter of Administration was given authorizing the audit and inventory of the property to Datu Punjungan Kiram ,son of Sultan MawalilWasit, this Letter of Administration is signed by Judge McKaskie of the High Court of North Borneo. The High Court of NorthBorneo also identified the nine principal heis entitled to received the monetary rental. The Letter of Administration has never been implement ted to this day due to World war II and after the turmoils to the hierarchy to the throne but the monetary rental was served .
