By this time, there was a powerful Abolitionist lobby, who were making it harder to create new slave-states. So Congress had to make a big gesture of appeasement to the South, to stop them seceding. The Fugitive Slave Act was saying, in effect "We can't offer you much hope of new slave-states. But by heck, we'll crack down on those runaways."
