The Dred Scott case had been in the court system in 1847. It reached the US Supreme Court and in March of 1857. The Court made several important rulings. They were:
1. Dred Scott was a slave and not a citizen;
2. Dred Scott could not be a US citizen because he was Black. No Blacks, even freed men could be US citizens;
3. Because Dred Scott was not a citizen, he could have no standing in a court of law; and
4. The Court ruled that slaves were property under the US Constitution, therefore the Congress nor a territory could ban slavery.
The impact of the ruling was that the Missouri Compromise and the Northwest Ordinance were unconstitutional acts. This was only the second time in US history that the Court had ruled that an act of Congress was unconstitutional. The Court also provided the legal standing for a White Republic, under cut the major issue of the Republican Party, and finally, through out the policy of popular sovereignty.

Dred Scott lived in Illinois, a free state governed by the Northwest Ordinance, and he and his wife lived together in the Wisconsin Territories, an unincorporated area controlled by Congress, that also prohibited slavery.One of the three judges in the Court of Appeals agreed with the District Court judge, but the other two upheld Irene Emerson's claim to ownership.Two of the nine US Supreme Court justices, Justices John McLean and Benjamin Curtis, also believed Scott and his family should be free.

In 1857 the US Supreme Court ruled that Dred Scott's application for freedom was rejected. Slavery was declared lawful in every state, because of the court's interpretation of the word 'property' in the Constitution, to include human property.
