A prohibition on cruelty to animals was included in the first legal code printed by Puritans of the Massachusetts Bay Colony in 1641. The first anti-cruelty law passed by a state legislature appears to be one enacted in New York in 1828. It provides that every "person who shall maliciously kill, maim, or wound any horse, ox, or other cattle, or sheep, belonging to another, or shall maliciously and cruelly beat or torture any such animal, whether belonging to himself or another, shall, upon conviction, be adjudged guilty of a misdemeanor."
