With the passage of the 13th Amendment the three fifths compromise became a moot point because slavery was abolished.

However, the 14th Amendment explicitly addressed the question when it stated 'Representatives shall be apportioned...counting the whole numbers of persons in each state excluding Indians not taxed...'
