No one person. What is now West Virginina was originally the western third of of Virginia.
In 1861 the people of Virginia were sharply divided on the question of secession but the division was largely geographic. Basically, the people in the western counties were dead set against it. When the state passed an ordinance of secession anyway, they refused to accept it and established a new state government, loyal to the union, and sent a new congressional delegation to Washington.
At first it was accepted that these were the legitimate representatives of the state of Virginia, as opposed to the "illegal" rebel government in Richmond. Eventually though it was decided simply to form apply for admission to the union as a new state.
The exact politics of that are obscure to me but that was what they did. Virginia objected, pointing to the provision in the U.S. constitution preventing a state from being divided without the consent of its own government. Since they were claiming to be out of the Union at the time though, nobody outside the Confederacy had much sympathy for that argument.
The area now known as West Virginia was early settled by various Native American tribes as early as 11,000 BC such as Paleo-Indians, Meso-Indians, Woodland Indians, and Mound Builders. Early European settlers included English and Germans.
