Tail lamps (taillight and brake in one lens)usually are double filament (two bulbs in one) and I surmise that one of the filaments are out. Check the bulb! Y-THINK-Y There is a grounding problem. Check the taillight ground or the wire or connection to the bulb socket.

you have a wiring problem with either the dash lights, the headlight switch, the tail lights or the front clearance lights. If you've had an accident that has caused damage to any of those areas, check that first.
Usually this a faulty signal light switch. The Signal light switch disconects the brake light on the signaling side and makes it flash.

It depends on if the tail light works or not. What would happen is, the Driving Tester would check your vehicle, registration, insurance, state inspection, and etc. I'm pretty sure that if you have a broken tail light, i.e. the tail light won't light up when you brake, you wouldn't be able to even take the test. If the tail light is cracked, but still works, I don't think it be a problem.
??? Your brakelights are only supposed to come on when using the brakes. Do you mean that your TAIL LIGHTS don't work? Hey Jose==Your TAIL lights may have a fuse blown or something could be wrong with the head light switch. You just have to check it out. GoodluckJoe The tail light bulb has two filaments in it. One for the tail light and one for the brake light. The brake light part is still connected but the one for the tail light is broken. All of this is inside the bulb. Happens all the time. Just need to replace the tail light bulb.

If the back dash light will light when the brakes are applied but the two tail lights will not light up, there is probably a short in the wiring somewhere. It could also be that the fuse for the brake lights is burned out.
Replace the light bulb. Tail lights are usually dual filament, 2 filaments in one bulb.
