Does ga offer short term disability?

User Avatar

Asked by Wiki User

I think it depends on the company and their Short Term Disability plan. The company I work for does have maternity in there short term disability thankfully. Ask your Human Resources Director or your manager. They should be able to pull up the company's disability plan. The state of Georgia does not have a mandatory short term disability program. It leaves the choice up to the employer.

Short term disability programs sold via workplace marketing will provide a maternity leave benefit, provided you enroll preconception. If your employer does not offer short term disability, it's easy to ask them to do so. Your employer simply needs to agree to deduct the premium from your pay, and forward the premium collected to the insurance carrier once a month. There is no direct cost to your employer, and no obligation to fund any premium not deducted from your pay.

== == It doesn't look like your protected under the Federal Family Leave Act Synopsis of Law Covered employers must grant an eligible employee up to a total of 12 workweeks of UNPAID leave during any 12-month period for one or more of the following reasons: for the birth and care of the newborn child of the employee; for placement with the employee of a son or daughter for adoption or foster care; to care for an immediate family member (spouse, child, or parent) with a serious health condition; or to take medical leave when the employee is unable to work because of a serious health condition. http://www.dol.gov/esa/whd/fmla/ What does the Employee Manual say? Thanks for helping. Co. Manual states: "If an employee fails to return to work after the leave, the Company may recover from the employee the premiums it paid during the leave, unless the failure to return is because of serious health condition or other circumstances beyond the employee's control." So to answer your question. The manual really doesn't address what is concerning me. This is the situation. Tell me what you think? I plan on taking my maternity leave and there is a possiblity that my husband will be starting his own company so I would like to, upon my return, put my two weeks in to my company to stay at home and help with the family business. Should I wait a certain amount of time upon my return to do this because I have heard of that some employers might be able to charge the back premiums? Thanks again for the additional help or advice.

Can you get fired while you are in maternity leave?

User Avatar

Asked by Wiki User

No, you can not be fired for being pregnant. There used to be a major problem with this, until the Pregnacy Discrimination act of 1978 put a stop to it. It is now a violation of federal law. The Family and Medical leave act went a step further and prevented employers from firing employees for reasons related to pregnancy such as the employee or their family's serious health conditions and further defined maternity leave as 12 weeks that the employer must grant. If you are fired for being pregnant you should immediately file a complaint with the US Department of Labor, Equal Employment Opportunity Commission as well as your state's civil rights commission or like organization. You should also retain legal counsel experienced in employment discrimination to specifically look out for your interests.

How long do you have to have short term disability before getting pregnant?

User Avatar

Asked by Wiki User

Your policy must begin before getting pregnant. Try to start your policy at least 3 months before conception.

Most policies contain a 9 or 10 month exclusion for normal delivery. Not every pregnancy goes full term. If your policy starts 3 months before conception and you deliver early, your delivery will most likely fall outside the exclusion period - making your maternity benefit payable.

When do you leave for maternity leave?

User Avatar

Asked by Wiki User

This isn't so much a health question unless you are having problems carrying the baby to term and your doctor has suggested you stay in bed. If that is not the case, it is usually more of a financial question, depending on how many weeks of paid maternity leave you can expect, if any. Whether you can begin getting paid maternity leave before the birth of your baby depends on what your employer allows. -------- At my work the earliest you can leave is 11 weeks before the due week. I believe this is according to the UK law.

Can obtain short term disability on my own?

User Avatar

Asked by Wiki User

Finding Short Term Disability (STD) insurance on your own is fairly difficult. This is a very niche market right now and only limited carriers are offering it. Mutual of Omaha is one company that does offer individual STD, but can sometimes be a bit pricey.

When looking at individual STD, you should know that benefits may be limited. Many times, women who do not have STD offered at work will look for this type of coverage when they are thinking of having children. Individual STD will not cover normal pregnancy, or at least not any policy I've ever seen.

The easiest way of obtaining STD insurance that will cover pregnancies is to have it offered in a group setting. This does not mean that the employer will have to pay benefits. STD can be offered on a voluntary basis, as long as required participation levels are achieved.
