What is a Collateral Contract?
A collateral contract is a contract which assigns the rights and/or obligations of an existing contract to a third party. Due to the doctrine of "privacy of contract" only those parties mentioned in a contract have rights and obligations and it is illegal to assign these rights and obligations to third parties without the consent of the other parties to the main contract. Collateral contracts overcome the privacy of contract doctrine.
Collateral contracts are used in the construction industry to make a direct contractual relationship between clients and sub-contractors. In the collateral contract the client will promise to pay the sub-contractor for the works that the main contractor promised the client to undertake. This collateral contract comes in handy when the main contractor goes insolvent or has late payments or, more importantly, when the subcontractor's performance is substandard.

Do you still have to pay on your repossessed car or what happens?
When you fall behind on your car payments the bank will put out a repo notice, you then have so many days to contact the bank and either make payment arrangements with them to pay back the money you owe, or to pay off your loan in full.
If you do not contact the bank, or if it's already been a while since they repo'd your car, what happens next is the bank sends your car to an auction.
They will then auction your car, and for example say they get $10,000 in the auction, but you still owe $15,000 on your loan... the amount that you will still owe the bank would then be $5,000 plus the fee for the auction, the fee for the towing company who picked up your car and any storage fees, plus the money you defaulted on in the first place... for example 3 months of car payments that you were behind.
They will send you out a notice to your last known address telling you how much you owe, how much they got in the auction, the balance after the auction, and then the fees I mentioned added on top of this.
You will have so many days to pay them this amount, if you don't they will put this onto your credit report and in some cases they will take you to court to sue you for the balance remaining.
The judge will then order you to pay the money, or to make payments, if you still don't comply you could then be found in contempt of court and face additional fines and even jail time.
It will now be very difficult for you to get another car loan from anywhere for the next 7 to 10 years since they will see your repo as soon as they run your credit report and with the way our economy is these days, there will not be a bank willing to put their money up on a loan to someone with a bad record of not paying back what they borrowed in the past since no bank will want to take the chance on losing their money too.
Can repo man drive by house in undercover car?
Yes, a repo man can drive by a house in an undercover car. They employ various means to see where people are hiding their cars and are usually allowed to take them unless they are in a private garage.
Can a repoman move another car to get to mine?
yes as long as it does not leave your property in Florida at least
Answer
He's right, in Florida it is perfectly legal to move a car blocking the car you are trying to repossess. I am actually looking for the Florida Statute that actually says it, as we have a car that is being blocked, but we don't want to move it, just in case the guy does come out, without something written explaining that we are allowed to do it.
You tell her to give you your money or threaten to call the police. If that doesn't work, call the police.
Do the police need to be contacted before a repo?
It depends on the locality. In Tennessee, no. A finance company can repo a car at any time if the payment is past due. In some states, it requires a court order and police officer sometimes accompanies the repo agent to the location.
If I pay bi weekly and have missed one payment. Can they repo my car?
You will have to speak with your finance company to determine when they will repossess your car. Each company has different rules and requirements and in most cases if you contact them about the missed payment they may be able to make payment arrangements with you.

How much does a bankruptcy lawyer make?
I've been practicing law for 30 years, predominately bankruptcy for the past 15. Last year I netted $400K, mostly from consumer bankruptcy filings. As long as banks and mortgage servicers remain stupid as dirt the future is bright!
