Yes you can select whatever coverage you want through your employer. However, your enrollment is through your employer and they usually only allow you to make changes to your coverage during open enrollement (the beginning of the year most commonly).

If you and a spouse have different health insurance but have never designated one as primary or secondary could this cause problems when you do designate primary or secondary?

If you have insurance through your employer, and you are the policy holder,(the insurance is in your name) this insurance will be primary for you, and your spouses insurance policy will be secondary. The insurance policy thru your spouse's employer, (your spouse is the policy holder, or the insurance is in their name), this would be primary for your spouse, and your policy would be their secondary. Can an employer deny coverage to spouse who has lost health insurance?

Assuming the employer offers coverage to spouses, then the employer would not have the right to turn a spouse away. The spouse's loss of coverage is a "qualifying event" and the employer's insurer would allow the spouse to join.

Who pays first if you have medicare and are retired hourly from General Motors?

Chances are Medicare would pay first as long as you are no longer working, or if your spouse does not have you covered under insurance through their employer. If your spouse IS working and you do have coverage through them, the group insurance would be primary if their employer has more then 100 employees working for them. Otherwise, Medicare will be primary.

Can an employer legally deny coverage for a spouse if the spouse's employer offers health insurance and the spouse is pregnant?

Generally insurance coverage should be offered to an employees spouse. It does not matter if they are offered coverage from their employer whereas it provides an additional option in case 1 plan is more affordable than the other.

If insured by your employer and your spouse's employer which is the primary insurance?

Your insurance through your employer is your primary insurance, and your spouse's primary insurance is through his/her employer. If both husband and wife are insured on both insurance policies, then you have primary and secondary coverage. But you will still have to pay any deductibles and co-pays before either policy will pay. The deductible is the amount you first have to pay (usually at the first of the year) before the insurance will pay anything. The co-pay is your percentage of what the insurance doesn't pay, which for many health insurance companies is 80% for them and 20% for you. There is sometimes a co-insurance that you have to pay also. Ex: Insurance companies have a set amount that they pay for any office visit, procedure, etc. If the bill is over what the insurance pays, then you are responsible for the balance.

Is it illegal to remove spouse from health insurance without their knowing?

No, it is not illegal. If it is a group plan (through an employer), the employee could submit the enrollment change without the spouse's signature. The employer or insurer would not question it, since he or she is still married to the person. The spouse would know that he or she had been dropped when a COBRA notice arrives, assuming the employer offers COBRA coverage.

Can an employer refuse insurance coverage to a same sex spouse?

Not in the United States or Canada, unless the employer also refuses insurance coverage to opposite-sex spouses.

If you have insurance with your employer and your spouse has insurance on you also which insurance is the primary?

If both you and your spouse have full medical coverage then the insurance compnay will revert back to your and your spouse's date of birth. Whoever's birthdate is first in a calendar year, then that is the primary insurance. For example, if your birthday is November 1, but your spouse's birthday is February 12, then your spouses insurance is primary for both of you.

Can your spouses employer or spouse remove you from a family insurance policy without your knowledge?
