It is my understanding that an application for employment constitutes verification of an ability to perform the duties requisite to the job applied for. This is a proclamation of the belief that you are fit for service under the terms of employment. If this is done while receiving disability insurance payments, it can be interpreted to mean that such benefits were sought with an intention to defraud. The supposition would most likely be that the doctor was fooled into believing that a disability existed where there was none; and, any subsequent firing due to a lack of performance could be construed as an unwillingness to work rather than any inability or disability. The issue will be one of truthfulness, with your credibility in doubt. As your testimony by way of work application attests your belief that you are not disabled from the requirement standpoint of the job for which you applied, such written proof of that belief will be deemed evidence that you no longer have, in your own estimation, any disability. The fact that your appeal was unsuccessful tends to verify and strengthen the veracity of this evidence. Your monetary obligations and lack of means for meeting their satisfaction is not a consideration; and, these are not the responsibility of the insurance carriers or the court--- fraudulent payments are... An escalation of court involvement may be pending, if the carrier believes there is merit in pursuing criminal prosecution on these grounds, or has a belief that reimbursement of divested payments may be accomplished through other legal action.

If your plan does not exclude work-related disabilities, then you would be able to file both claims. You would just want to make sure that when filing, each carrier knew about the other.
