Can the collectors put a lien on your wages and a truck that you own for a prior repossession in Texas?

Perhaps because, like Texas, these states severely restrict one of a creditor's most effective tools -- wage garnishment. Texas bans wage attachments except for child support, and the Carolinas have similarly strict laws.

In addition, Texas has some of the most liberal creditor exemptions in the country -- which means that creditors can't take most people's stuff. Texas doesn't allow creditors to go after residents' homes, regardless of value, as long as the property is less than 10 acres in a town or city or 200 acres in the country. One car per family member is also sacrosanct, as is personal property of up to $60,000.

You really need to speak with a lawyer about this. It's all dependent on the bankruptcy laws in your state, what chapter you're filing for, etc. If the vehicle has an order for repossession on it prior to when you filed for bankruptcy, you may not be able to prevent it.

If it's a commercial tractor trailer, and there's a load in that trailer, they may not take it, as the order of repossession does not cover the load, and they will face criminal charges if they do such.In the course of repossessing a vehicle, the repossession agency may not enter or move any vehicle (including a trailer) which is not in their order for repossession. They may detach a trailer from a truck being repossessed, but they can't actually take it.

My truck was reposessed and the repo company dragged my truck out of my gravel driveway and ruined the driveway. Plus they took my truck to another state almost 3 hours away. I plan on getting the truck back but I wonder if I have a case for compensation for my driveway and any damages to my truck by being dragged, and it being taken to another state?

I would not think so. It was just a trim package called Durango. I cannot see how this would ever be a truck collectors would covet.

In Tennessee, a truck or car finance company can hire a repossession company to take your vehicle if you do not make payments and are in default. They are not able to break into a locked garage to take your vehicle and they cannot forcibly remove a person from behind the wheel of the car.

The California Business and Professions Code is very clear on this point. The code states the following: With regard to collateral subject to registration under the Vehicle Code, a repossession occurs when the repossessor gains entry to the collateral or when the collateral becomes connected to a tow truck. Nope. It is a repossession. I take them in the middle of intersections if I have to. All legal. As long as I do not hit you personally.
