The age of majority in TX is 18. Anyone under 18 is a minor. That means Mom and Dad get to decide where you live unless you have been emancipated. In order to be emancipated you would have to provide the court with a valid reason why it would be in your best interest, and you would have to prove that you are capable of fully supporting yourself and your child without any assistance.
A 17-year-old can move out, but certain conditions must be met. They must obtain a family law lawyer to help with the legal aspects of emancipation and be a legal resident of Texas. They must be able to prove that they are able to support themselves on their own.
It is very difficult to be emancipated under the age of 18, and it is the responsibility of the minor to prove their case. The judge looks for several things, including whether the person is capable of making a living and supporting themselves. Also, they try to determine whether the child will be able to mentally handle the rigors of life on their own.
I would answer that it depends.
From my knowledge, Texas law allows a child to leave home at seventeen on their own free will.
I am pretty sure that if the child has completed high school (diploma, GED, or equivalent), the parent no longer has an obligation to support the child.
However, at eighteen you can require a child to leave home.
Please remember that this is not legal advice, and you should consult a lawyer or a legal aid clinic for any legal inquiries - remember the internet is full of misinformation from pseudo-lawyers interpreting the law with the help of Google, instead of years of experience.
Technically, you're not legally able to make that choice, but there is a loophole in Texas law. Officers can't force you to move back in with your parent/gardian unless your life is in danger or you're in a harmful environment. The officers may make you call and check in with your parents, and inform them of your whereabouts. But if your parent files a criminal complaint with the courts, you will be forced to. Also, if you move out, you must continue school.
The age of majority in TX is 18. You cannot legally leave home prior to turning 18 unless you have your parents' permission or you have been emancipated.
