At all times when dealing with a significant life and legal issue such as custody of a child a professional legal practitioner should be consulted. If finance is an issue you can try to gain assistance by contacting your local community legal aid centre. Courts that deal with family law and custody related issues can also be a good first point of contact for finding out where to get further help - they might even help you with an initial query. I am in Australia and have an understanding of Australian law so if you want further assistance from me you will need to stipulate which country you live in and I might then be able to help you further. If you are in America I can do some basic research for you, once I know which state you live in, and try to help further that way. I wish you the best with a most difficult time in life.

What about West Virginia? Already married, in an abusive relationship, 2 children under 2.

* If you have joint custody then yes, he does need your permission to take your baby out of the UK. If he has sole custody he can take the baby anywhere he wants.

Single mothers have sole custody until the court rules otherwise, but in Texas you can get a jury trial.
