If you are a US cit. and you married a Mexican that came in illegally and already file and just waiting on interview how long is the wait and is heshe able to attain residency file an I-130?

It depends on when you got married. Did you spouse file papers with Immigration, before you were married? Do you have a lawyer? Did they pay their fines for coming here illegal, get a physical, etc..... Also they changed the law in 2001, if you go married recently, your spouse will have to return to Mexico for at least 6 months, with a year being more likely. They would have to stay until they are approved.

Yes but you're not guaranteed papers depending if he has a record or has been caught crossing the border but my friend got married to an illegal and theyve been married for one year just last week and he was given temporary residency for 2 years already and in 2 years he needs to apply for permanent residency. It does help if you have a child but i wouldn't recommend getting pregnant just for that reason. Oh and they do not have kids and he was caught crossing the border. but still got it.

If the petition is accepted after being filed that illegal must return to their home country to await a perm. residency interview at the local US Embassy. As well as possibly pay fines for being here illegally in the first place. If the interview goes well they will get a visa to enter the US on a perm. residency based on marriage to a US citizen. (I assume if they are a US soldier) If the US soldier is NOT a citizen the wait time is much much longer and the possibility for denial goes up higher.

they would call in less than six months for an interview to see if you are really married to the American citizen. then they will issue a conditional permanent card for two years. when that card expires you would have to go to another interview to see if you do not commit marriage fraud, if you pass they will issue a permanent card for ten years.
