The minimum height for a pool fence is 48 inches not 36 inches. In fact some areas of the US require the minimum height to be 60 inches so it is best to check with your local department of inspections. If for some reason your in an area where the local department of inspections does not require a fence, just know that your insurance company will.
Some other requirements for your pool enclosure include that your pool gate must open away from the pool and it must be self closing (I recommend the Tru Close Hinge) and self latching (I recommend the Magna Latch). Also, no gap in the fence can allow a 4 inch sphere to pass through it.
