Because some are rewired wrongly and so when they brake the indicators may flash and when they indicate the brake lights light up.

Cars in North America (Canada, America, Mexico) and some other countries designated as 'federal' (I think these are Dominican Republic, Saudi Arabia and Korea) have red rear indicators, they are not rewired incorrectly they are manufactured this way.

What causes both turn signal lights to flash when either signal is turned on and to stop when brake is applied only when lights are on?

It depends on the car. Some cars require that you turn on the turn signals to make the 4-way flasher work. If that's the case with your vehicle, make sure the emergency flashers aren't on. Otherwise, it's probably a problem with the turn signal switch.

Is it illegal to drive using hand signals?

Absolutely not. Before flashing lights were put on cars, hand signals were all that was available to indicate a turn. In fact, hand signals were once required (in Louisiana, at least) even if your vehicle had flashing signal lights. It's important to know and be prepared to use hand signals in the event your signal lights malfunction. Source: common sense
